These Terms & Conditions (“Terms”) govern your access to and use of Peak State Wealth (the “Service”), operated by Peak State Global (“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. About the Service
Peak State Wealth is a financial information and analytics tool. It aggregates business and personal financial data from sources you choose to connect — such as accounting platforms, banking and personal-finance services, and files you upload — and presents that data as dashboards, budgets, trends, goal tracking, and related insights.
The Service is a read-only reporting and planning tool. We are not a bank or authorised deposit-taking institution, we do not hold, transmit, or control your money, and the Service cannot initiate payments or transactions on any of your accounts.
2. Not financial, tax, credit, or legal advice
General information only — not financial advice. The Service provides general information and factual data presentation only. Nothing in the Service constitutes financial product advice, tax advice, credit advice, accounting advice, or legal advice, and nothing in the Service should be relied upon as such.
- Peak State Global does not hold an Australian Financial Services Licence (AFSL) and is not licensed to provide financial product advice under the Corporations Act 2001 (Cth).
- We are not a registered tax agent under the Tax Agent Services Act 2009 (Cth) and do not provide tax agent services.
- Nothing shown here — including any figure, projection, score, signal, or insight — takes into account your objectives, financial situation, or needs.
- Before acting on anything shown here, confirm the decision with your accountant and/or a licensed financial adviser who can consider your personal circumstances.
3. Accuracy of information
Data in the Service comes from third-party sources (banks, accounting platforms, aggregation services) and from files you upload. That data may be delayed, incomplete, duplicated, miscategorised, or otherwise inaccurate, and currency conversions, balances, and derived figures (such as savings rates, runway, or net worth) may be wrong as a result. Some features use artificial intelligence to categorise transactions or generate insights; AI-generated output can be incorrect. Always verify figures against your source records (bank statements, accounting software, official documents) before relying on them.
4. Eligibility and accounts
You must be at least 18 years old to use the Service. You are responsible for keeping your login credentials confidential, for all activity under your account, and for notifying us promptly of any unauthorised use. If you share a workspace with another person (for example, a household), you are responsible for the access you grant them to your financial data.
5. Connected services and your authority
When you connect a third-party source (such as an accounting platform, bank API, or personal-finance service) or upload a file, you confirm that you are authorised to access and share that data. Your use of connected third-party services is governed by their own terms; we are not responsible for their availability, accuracy, or conduct. You can disconnect a source at any time, which stops new data being collected from it.
6. Acceptable use
You must not:
- use the Service for any unlawful purpose;
- attempt to gain unauthorised access to the Service, other users’ data, or the systems it runs on;
- interfere with or disrupt the Service, or circumvent usage or security controls;
- reverse-engineer, scrape, or copy the Service except as permitted by law;
- upload content that is malicious, infringing, or that you have no right to provide.
7. Your content and data
You retain ownership of the financial data and content you connect or upload. You grant us a limited licence to host, store, process, analyse, and display that data solely to operate and improve the Service for you, as described in our Privacy Policy.
8. Intellectual property
The Service — including its software, design, charts, text, and branding — is owned by or licensed to Peak State Global and protected by intellectual property laws. You may not use our branding without prior written permission.
9. Third-party services and links
The Service relies on third-party infrastructure and may link to third-party websites. We are not responsible for third-party services or content, and linking does not imply endorsement.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.
11. Disclaimer of warranties
Subject to clause 10, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or uninterrupted availability.
12. Limitation of liability
Subject to clause 10 and to the maximum extent permitted by law: (a) we are not liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, savings, data, or opportunity, arising from or in connection with the Service — including any decision you make in reliance on information shown in the Service; and (b) our total aggregate liability arising out of or in connection with the Service is limited to the total amounts (if any) you paid us for the Service in the 12 months before the event giving rise to the claim.
13. Indemnity
You indemnify us against loss arising from your breach of these Terms or your unlawful use of the Service, except to the extent we caused the loss.
14. Suspension and termination
You may stop using the Service and request account deletion at any time. We may suspend or terminate access for breach of these Terms, security risk, or lawful requirement. Clauses that by their nature should survive termination (including clauses 2, 3, and 10–13) survive.
15. Changes
We may update the Service and these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Service after changes take effect constitutes acceptance.
16. Governing law
These Terms are governed by the laws in force in Australia. You and we submit to the non-exclusive jurisdiction of the Australian courts.
